Terms & Conditions

These Terms and Conditions set out the agreement between US and YOU the client that applies when you purchase/book any of our services.

FMK Health Suite 2, Arran House, Arran Rd, Perth PH1 3DZ shall be referred to as Us, We and the client/patient shall be referred to as You, Your.

We agree to provide any physiotherapy & massage therapy services including any assessment, diagnosis, advice or treatment as set out with-in our booking system within a safe environment either located in our studio.

We cannot be held responsible for any environmental or location issues presented when we perform our services within your home or a care home facility. You the client will be responsible for making sure that the location is free from clutter & danger.

These Terms and Conditions form an understanding between you the client and Us FMK Health, except for those terms implied by law, which cannot be excluded and any other terms specifically incorporated by reference – no other terms apply.

By booking a service or treatment, will be acceptance of these terms.

Our Terms and Conditions can change at any time without prior written or verbal notice, these terms were set in December 2022

USE

Use of our service: We expect you the client to be prompt and arrive as close to your appointment time as possible (5 minutes prior) to make sure your appointment runs on time.

Clients who attend late to appointments will only be eligible to the remaining time available, FMK Health cannot be held responsible for any delay in You the client attending the appointment.

Liability

FMK Health will not be held liable for any loss or damage (in contract negligence or otherwise) where:

  • any damage, upset or cause of your emotional well-being including, but not limited to, any embarrassment caused;

  • any loss of income or anticipated profits;

  • Any loss of payment, money or opportunity that arises from having to attend an appointment.

  • Loss of reputation, or stature due to injury and treatment there off.

  • losses suffered by third parties; loss caused by any indirect actions as a result of injury.

Nothing in these Terms and Conditions excludes or limits Our liability for death or personal injury caused by Our negligence or for fraud or fraudulent misrepresentation. Nothing in these Terms and Conditions affects Your statutory rights.

Cancellations

Missed Appointments: FMK Health will not be held responsible for the client missing any appointments, No shows WILL be invoiced a cancellation fee.

Cancellations: FMK Health require 24 hours notice if You, the client, wishes to cancel their appointment.
